Article 1 — Scope and Definitions
1.1 Scope
These General Terms and Conditions of Sale ("Terms") govern all sales of products offered on the website the-vestige.com ("the
Website"), operated by Monde Singulier SAS, a French simplified joint-stock company (société par actions simplifiée) registered
under SIREN 912 338 431, with its registered office at 73 rue du Faubourg Poissonnière, 75009 Paris, France ("the Seller").
1.2 Definitions
"Buyer" means any natural or legal person placing an order on the Website, whether acting as a consumer or a professional.
"Product" means any item of furniture, decorative object, artwork, or lighting offered for sale on the Website. "Order" means a
purchase request placed by the Buyer on the Website. "Consumer" means any natural person acting for purposes outside their
trade, business, craft, or profession. "Professional" means any natural or legal person acting within the scope of their trade,
business, craft, or profession.
1.3 Acceptance
By placing an Order, the Buyer acknowledges having read and unreservedly accepts these Terms, which prevail over any other
document. The Seller reserves the right to amend these Terms at any time; the version applicable to an Order is the one in force on
the Website at the time the Order is placed.
1.4 Nature of Products
The Products sold on the Website are predominantly vintage, antique, or second-hand items. Each piece is unique or available in
very limited quantities. The descriptions and photographs are provided for indicative purposes; minor variations in condition, patina,
or appearance inherent to the age and history of the items do not constitute defects.
Article 2 — Products and Pricing
2.1 Product descriptions
Products are described and presented with the greatest possible accuracy. However, given the vintage nature of the items,
photographs are illustrative and may not capture every detail of patina, wear, or colour nuance. Any known defects, restorations, or
condition issues are mentioned in the product description. If additional information is required, the Buyer may contact the Seller
before placing an Order.
2.2 Prices
All prices are displayed in Euros and include applicable VAT (where relevant). Prices do not include delivery costs, which are quoted
separately. The Seller reserves the right to modify its prices at any time, but Products are invoiced on the basis of the price in effect at
the time the Order is validated. For sales subject to the VAT margin scheme (régime de la marge), VAT is not shown separately on
the invoice.
2.3 Availability
Products are offered subject to availability. In the event a Product becomes unavailable after an Order has been placed, the Buyer
will be promptly informed and offered a full refund.
Article 3 — Orders
3.1 Order process
The Buyer selects the desired Product(s), adds them to their cart, completes the required information, and validates the Order by
confirming payment. An order confirmation email is sent to the Buyer, summarising the Order details. The sale is finalised upon
receipt of full payment.
3.2 Verification
The Seller reserves the right to refuse or cancel any Order in the event of a payment incident, an incomplete or abnormal Order, or a
dispute concerning a previous Order.

Computerised records stored in the Seller's systems under reasonable security conditions shall be considered proof of
communications, orders, and payments between the parties.
Article 4 — Payment
4.1 Payment methods
Payment is made online at the time of Order by credit card (Visa, Mastercard, American Express), or any other method made
available on the Website. All transactions are processed through a secure payment platform.
4.2 Payment security
The Seller uses industry-standard encryption and secure payment processing (Shopify Payments / Stripe). The Seller does not store
credit card numbers on its servers.
4.3 Payment terms for professionals
For Professional Buyers, payment by bank transfer may be accepted upon prior agreement with the Seller. In such cases, the
Product is dispatched only after receipt of funds in full.
Article 5 — Delivery and Shipping
5.1 Delivery methods
Due to the nature of the Products (vintage furniture, fragile and often large items), all deliveries are carried out by specialised art and
furniture carriers. A customised delivery quote is provided to the Buyer after the Order is confirmed, based on the Product
dimensions, weight, destination, and any special handling requirements.
5.2 Delivery costs
Delivery costs are borne by the Buyer unless otherwise stated. The delivery quote is communicated before shipment and must be
accepted by the Buyer before dispatch.
5.3 Delivery area
Deliveries are available in mainland France and internationally. Delivery to certain locations may be subject to specific conditions or
additional charges.
5.4 Delivery timeframes
Delivery timeframes are provided as estimates and depend on the carrier's availability and the destination. The Seller shall not be
held liable for delays caused by the carrier or force majeure events. The Seller commits to dispatching the Product within a
reasonable period after payment and acceptance of the delivery quote.
5.5 Receipt and inspection
Upon delivery, the Buyer must inspect the Product in the presence of the carrier and note any damage or discrepancy on the delivery
slip. The Buyer must also notify the Seller in writing within 48 hours of delivery. Failure to report damage within this period may result
in the loss of any claim against the carrier or the Seller.
Article 6 — Right of Withdrawal (Consumers)
6.1 Scope
In accordance with Articles L.221-18 et seq. of the French Consumer Code (Code de la consommation), Consumer Buyers have the
right to withdraw from their purchase within fourteen (14) calendar days from the date of delivery of the Product, without having to
justify their decision or pay any penalty, subject to the conditions set out below.
6.2 Exercise of the right
To exercise the right of withdrawal, the Buyer must notify the Seller by email at contact@the-vestige.com or by registered letter,
using a clear and unambiguous statement of their decision to withdraw, within the 14-day period. The Buyer may use the model
withdrawal form appended to these Terms.
6.3 Return of Products
The Product must be returned in its original condition, without damage, within 14 days of the withdrawal notification. Return shipping
costs are borne entirely by the Buyer. Given the nature of the Products (fragile, high-value, often oversized furniture), the Buyer
must arrange return shipping using a specialised carrier with adequate insurance. The Seller may recommend a carrier upon request.
6.4 Refund
The Seller will refund the Buyer the full purchase price (excluding initial delivery costs, unless the Product was not as described)
within 14 days of receiving the returned Product or proof of shipment, whichever comes first. The refund is made using the same

payment method used for the original purchase.
6.5 Exclusions
The right of withdrawal does not apply to Professional Buyers. It also does not apply to Products that have been altered, damaged, or
used by the Buyer after delivery.
Article 7 — Legal Warranties
7.1 Warranty of conformity
In accordance with Articles L.217-4 et seq. of the French Consumer Code, the Seller is liable for any lack of conformity of the Product
at the time of delivery. Given the vintage and second-hand nature of the Products, conformity is assessed in relation to the product
description and any disclosed condition issues. Normal signs of wear, patina, and age-related characteristics described or visible in
photographs do not constitute a lack of conformity.
7.2 Warranty against hidden defects
In accordance with Articles 1641 et seq. of the French Civil Code, the Seller warrants Products against hidden defects that render the
Product unfit for its intended use or that significantly diminish such use. Any claim under this warranty must be made within two (2)
years of the discovery of the defect.
7.3 Exclusions
The warranties do not cover defects resulting from misuse, negligence, or modifications made by the Buyer after delivery, nor
damage caused during return shipping arranged by the Buyer.
Article 8 — Liability
8.1 Seller's liability
The Seller's liability is limited to the purchase price of the Product concerned. The Seller shall not be held liable for any indirect or
consequential damages, including loss of profit, loss of opportunity, or damage to other property.
8.2 Force majeure
The Seller shall not be held liable for any failure or delay in performing its obligations due to events of force majeure as defined by
Article 1218 of the French Civil Code, including but not limited to natural disasters, strikes, pandemics, government orders, or carrier
failures.
8.3 Website availability
The Seller does not guarantee uninterrupted access to the Website and shall not be liable for any temporary unavailability due to
maintenance, technical issues, or events beyond its control.
Article 9 — Intellectual Property
9.1 Content
All content on the Website (texts, photographs, graphics, logos, icons, and software) is the property of Monde Singulier SAS or its
licensors and is protected by French and international intellectual property laws. Any reproduction, distribution, modification, or use
without the prior written consent of the Seller is strictly prohibited.
9.2 Product images
Photographs of the Products are for illustrative purposes and may not be reproduced without the express authorisation of the Seller.
Article 10 — Personal Data
10.1 Data controller
Monde Singulier SAS, acting as data controller, collects and processes personal data necessary for order management, delivery,
customer service, and, subject to consent, marketing communications, in accordance with the EU General Data Protection
Regulation (GDPR) and French Law no. 78-17 of January 6, 1978 (Loi Informatique et Libertés).
10.2 Data collected
The data collected includes: name, email address, postal address, telephone number, and payment information (processed securely
via third-party payment providers). Data is retained for the duration necessary to fulfil the purposes for which it was collected, and in
any event for the duration required by applicable law.

The Buyer has the right to access, rectify, erase, restrict, and port their data, as well as the right to object to processing and to lodge
a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés). Requests may be sent to:

10.4 Cookies
The Website uses cookies to improve the user experience and for audience measurement purposes. The Buyer may manage cookie
preferences via the cookie consent banner displayed on the Website.
Article 11 — Dispute Resolution
11.1 Amicable resolution
In the event of a dispute, the Buyer is encouraged to contact the Seller at contact@the-vestige.com to seek an amicable resolution.
11.2 Mediation (Consumers)
In accordance with Articles L.612-1 et seq. of the French Consumer Code, Consumer Buyers who have not been able to resolve a
dispute directly with the Seller may refer the matter to a consumer mediator free of charge. The details of the competent mediator will
be communicated upon request.
11.3 Governing law and jurisdiction
These Terms are governed by French law. Any dispute arising from or in connection with these Terms that cannot be resolved
amicably or through mediation shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France.
Article 12 — Miscellaneous
12.1 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.2 Entire agreement
These Terms constitute the entire agreement between the Buyer and the Seller with respect to the sale of Products on the Website
and supersede all prior agreements, representations, or understandings.
12.3 Language
These Terms are drafted in English. In the event of a discrepancy between the English version and any translation, the French
version shall prevail for legal purposes.
